Terms of Service

The terms for the PrivacyAI website, the free scan and the removal service.

Last updated: November 8, 2026

These Terms of Service are an agreement between you and Erase Technologies, LLC, doing business as PrivacyAI ("Erase", "we", "us"), 3050 Biscayne Boulevard, Suite 400, Miami, FL 33137, privacyai@erase.com. They cover the PrivacyAI website, the free scan, and the PrivacyAI data broker removal service (the "Service"). They apply only to PrivacyAI, not to other services offered on erase.com.

You accept these Terms by ticking the box that says so when you run a free scan or subscribe. If you only browse the website, these Terms apply to that use. Please also read our Privacy Policy, which says what we do with your information, and our Refunds & Cancellation page. If you subscribe, you also sign a separate Authorization that appoints us as your agent.

1. What the Service is

We perform a service for you, as your authorized agent. We search data broker and people-search sites for listings about you, submit opt-out and deletion requests for you, receive and answer those sites' messages, check again on a schedule, and file again if a listing stays up or comes back.

The work is automated, with our team handling exceptions. Your dashboard is how we report results to you. It is included in the Service at no separate charge. We do not sell you software, and there is nothing for you to install or operate.

2. Who can use it

  • You must be at least 18 and live in the United States. We do not enroll minors.
  • Each subscription covers one person: you. You may not subscribe for, or enter the details of, anyone else.
  • You must give us information that is true and that is your own, and keep your login to yourself. You are responsible for what happens under your login unless it was not your fault. Tell us right away if you think someone else has used it.

3. The free scan

These terms apply each time you run a free scan, on top of the rest of these Terms.

  • For yourself only. You confirm that the name and city you enter are your own, and that you are at least 18 and are running the scan for your own personal use. You may not scan anyone else, including a family member, partner, tenant, employee, customer or person you are curious about.
  • Prohibited uses. You may not use a scan or its results to decide anyone's eligibility for credit, insurance, employment, housing or any similar purpose; to locate, contact, harass, stalk or monitor anyone; or for any commercial purpose or resale. We are not a consumer reporting agency, and scan results are not consumer reports or background checks.
  • What you authorize. You ask us to search broker and people-search sites and search engine results using the name and city you enter, as your agent, for your own privacy purposes. Those sites and the companies that carry the searches therefore receive what you enter. We do not submit removal requests from a free scan, and a free scan does not make us your agent for anything else.
  • What results mean. Matching is automated from a name and a city, so results can include people with the same or a similar name, and can miss listings that are yours. "Likely" and "possible" matches are not confirmed matches. Counts shown as being "under your name" are figures for that name on the site, and can be about other people entirely. Record types a site advertises are what that site offers, not something we found about you. Details are masked on purpose. A site that does not appear may simply have been unavailable or not searched.
  • Your information. What you enter and your masked results are deleted within 24 hours. See "Free scan" in our Privacy Policy.
  • Limits. We may limit, refuse or stop scans, including to prevent misuse, and may ask you to verify your identity. The free scan comes with no promise of accuracy or of removal, and running one does not oblige you to buy anything.

4. Your authorization and our role as your agent

Before we file anything, you sign an Authorization appointing us as your agent for privacy requests. It says what we may do, and what we may not. If it and these Terms disagree about what we may do for you, the Authorization controls.

  • We may use the identifying details you give us, and details shown on listings matched to you, to find listings and file requests. We may use email addresses and phone numbers we control for those requests.
  • We act as your agent, not as you. We will not tick a box or make a statement that only you could truthfully make, and we will never sign a declaration under penalty of perjury for you.
  • We may give a copy of your signed Authorization to any site that asks for proof that we may act for you.
  • You can revoke your Authorization at any time yourself, from your dashboard (My info, then Your authorization). We then start no new requests for you and stop following up on requests already sent, which pauses the Service in practice because we cannot act without it. You can sign the Authorization again from your dashboard at any time, and we pick up where we left off. Revoking does not by itself cancel your subscription or release any payments left in your plan's term, unless the law says otherwise.
  • We are not your lawyers and do not give legal advice. We may refer to rights you have under privacy law when we file a request, but we do not represent you in any dispute.

5. What we need from you

Most of the work needs nothing from you, but some sites set conditions we cannot get around:

  • Date of birth. Date of birth is optional at sign-up, but some sites will not process a request without a full date of birth. Such a site may not already have yours. If you do not give it to us, we cannot file at those sites.
  • Your own confirmation. Some sites may insist on hearing from you directly, for example to confirm the request or your identity, as California's regulations allow for deletion requests. We will tell you when that happens and we cannot find another route. Without your response, that request may not go through.
  • Possible matches. Where we are not confident a listing is yours, we do not file until you confirm it. If you confirm a listing that is not yours, a request may be filed about someone else, so please only confirm listings that are really about you.

6. No guarantee of removal, and legal rights vary by state

We work to remove your listings and we report what actually happens, but we do not guarantee that any listing will be removed, stay removed, or be removed by a particular date. The sites decide, and we do not control them.

  • Your legal rights depend on where you live. California is the only state whose law requires a business to act on a deletion request from an authorized agent. About a dozen other states give agents a legal role for opt-outs only. Many states have no general privacy law, and there we rely on each site's own voluntary opt-out process. We do not claim you have a legal right to deletion everywhere.
  • Exceptions. Privacy laws generally do not reach publicly available information or activity covered by the Fair Credit Reporting Act, and sites often rely on those exceptions. Some sites will refuse, ignore or delay requests.
  • Listings can come back. Sites re-collect data, so listings can reappear, including after a removal we have confirmed. While you subscribe we check again and file again. After your subscription ends, we do not.
  • What stays out of reach. We work on the sites we cover. We cannot remove the underlying public records, news articles, social media, or other sites' copies, and a site may keep what it needs to honor a suppression.
  • What we count. Your dashboard separates requests we have sent, removals a site has told us about, and removals we have checked. A request we sent is not a removal.
  • What the Service is not. It is not identity theft protection, insurance, credit repair, or a way to improve your credit record or background check results.
  • California residents. California runs a free state service, the Delete Request and Opt-out Platform (DROP), which sends one deletion request to the data brokers registered with the state. You do not need us to use it, and we do not file through it for you. See privacy.ca.gov/drop.

7. Subscriptions, billing and renewal

The Service is sold as a subscription. Before you pay, the checkout shows the price, how often you will be billed, any minimum term and how renewal works, and you agree to them by ticking the box and completing your order. We email you a confirmation. Payment is taken by our payment provider on its own hosted page, and your card number does not reach our servers.

  • Charges. We charge your payment method automatically on each billing date, until your subscription ends. Prices do not include any tax that applies, which we add where we are required to collect it.
  • Minimum term. A plan with a minimum term is a commitment for that term, even if it is billed monthly.
  • Automatic renewal. At the end of each term your subscription renews automatically for the same term unless you cancel first. We email you before an annual term renews, and before any price change takes effect.
  • Failed payments. If a payment cannot be collected after reasonable retries, we may suspend or end your subscription.
  • Refunds. Refunds are handled as set out on our Refunds & Cancellation page, and as the law requires.

8. Cancelling, and what happens afterwards

You can cancel at any time, online, from your account. You do not have to call or write to us.

  • Cancelling stops the subscription renewing at the end of the current term. It does not end the term early. Any payments still due in the term continue on their billing dates, and we keep working on your removals until the term ends.
  • When your subscription ends, your Authorization ends with it and we file no new requests. Requests already sent stay with the sites that received them, unless you ask us to withdraw them, in which case we will send the withdrawal where the site has a way to receive one.
  • We stop using the dedicated email address and phone number for new requests. Replies to requests already sent may still reach us, and are kept and deleted as our Privacy Policy says.
  • We stop checking sites, so listings may reappear after your subscription ends.
  • We delete your data 90 days after your subscription ends, without you having to ask, and email you a week before we do. You can restart your subscription before then, or use Delete my info to have it deleted sooner.

9. Deleting your information

You can ask us to delete your information at any time with Delete my info, linked in the footer of every page, or by emailing privacyai@erase.com. If you have no subscription running, we delete it straight away. If you are within a paid term, we delete it when the term ends, and the term's payments and your removals continue until then. Nothing here limits any right to earlier deletion the law gives you: tell us if you believe you have one, and we will handle your request under that law. Our Privacy Policy says what we keep after deletion, and why.

10. Acceptable use

You may not use the website or the Service to do any of the following:

  • enter or request information about anyone but yourself;
  • break the law, or harm, stalk, harass or impersonate anyone;
  • scrape, copy or run automated queries against our website or free scan, or get around its limits or security checks;
  • interfere with or probe the website's security, or introduce malicious code; or
  • resell the Service or its results.

We may suspend or end your access if you break these Terms or if we reasonably believe your use is unlawful or puts someone at risk. If we end a subscription without cause, we will refund the part of any payment that covers time you did not receive.

11. Our website and content

You may use our website for your own personal, non-commercial purposes. Its content and the PrivacyAI and Erase names and logos belong to us or our licensors, and these Terms give you no other rights in them.

The website links to other sites. We do not control them and are not responsible for them.

12. Disclaimers

Apart from the promises in these Terms, and to the extent the law allows, we provide the website and the Service "as is" and "as available", and we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that they will be uninterrupted or error-free, or that information from third-party sites is accurate. Our website's general information is not legal advice.

13. Limits on liability

To the extent the law allows, Erase and its affiliates, officers, employees and service providers are not liable for indirect, incidental, special, consequential or punitive damages, or for what third-party sites do or fail to do, including a site's refusal to remove a listing or its reappearance. To the extent the law allows, our total liability for all claims relating to the website and the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose and US$100.

Nothing in these Terms limits liability that cannot legally be limited, including for fraud, or for gross negligence or willful misconduct where the law does not allow it, or takes away a consumer right that cannot be waived under the law of the state where you live.

14. If you misuse the Service

To the extent the law allows, you agree to cover the reasonable losses and legal costs we incur from a third party's claim caused by you entering someone else's details, giving us false information, or breaking section 3 or section 10. This does not apply to the extent we caused the loss.

15. Governing law and disputes

Please email privacyai@erase.com first, so we can try to sort out any problem directly. These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules. Any dispute that goes to court will be resolved in the courts located in Charlotte County, Florida, and you and we agree to their jurisdiction. Even so, you may bring a claim in small claims court where you live if it qualifies, and nothing here takes away the protection of any consumer law of your home state that cannot be waived by agreement.

16. Changes to these Terms

We may change these Terms. If a change is material, we will email subscribers at least 30 days before it takes effect, and post the new date above. A change does not apply to a dispute that arose before it. If you do not agree to a change, you can cancel before it takes effect, and your plan's existing commitments continue as agreed. If we change the Authorization, we will ask you to sign the new version.

We may also change or discontinue parts of the Service. If we discontinue it entirely, we will tell you in advance and refund any amount you paid for time after it ends, and no further payments will be due.

17. General

  • These Terms, the Authorization and the policies they mention are the whole agreement between you and us about PrivacyAI.
  • If a part of these Terms cannot be enforced, the rest still applies.
